These terms are a legal agreement between:

"you" the user of this website or client where a contract has been entered into and "Clare Amanda Photography" whom runs this website.

By using this Website, booking sessions (services) or purchasing goods and products, you agree to and accept the following terms.

Any calls to Clare Amanda Photography are at the standard rate for calling a UK mobile.

All content on this website including but not limited to images is Copyright Clare Amanda Photography (or the photographers thereof) and are protected by the Copyright and Design Act 1988. The third party website and theme providers reserves all rights over this website’s structure, fonts and code which may not be copied or reverse engineered in any way for any purpose . No part of this website or its contents may be copied, downloaded, reproduced or reverse engineered by you for any reason without the express written permission of the respective Copyright holder. Digital images may be offered for purchase by you and are subject to a separate licence for use which must be adhered to.

Quoted Prices and Tax

All prices quoted on this website and those provided in any written quote are exclusive of VAT.  Clare Amanda Photography is not VAT registered so VAT is not applicable on the sale of products and services offered.

Offers and discounts may occasionally offered and should be discussed with Clare Amanda Photography at the user’s initial consultation with Clare Amanda Photography or prior to purchasing products.

Terms of Service

Description of Services and Prices

Clare Amanda Photography's services are described as "sessions". With the exception of bespoke sessions, up to date details and prices of sessions offered by Clare Amanda Photography can be found on the prices page. Bespoke sessions will be clarified and agreed in writing by both parties in the contract.

Sessions can be booked and purchased either via my website or social media pages (for certain sessions only) or following a telephone or in-person discussion with Clare Amanda Photography and the agreement of a suitable session date. Upon booking a session, a contract with its own terms and conditions will be supplied for your agreement. A copy of your contract along with its terms and conditions can be requested at any time from the day it was signed.

Payment Methods

Payment for sessions can be made by most major debit or credit cards (in person only), cheque, bank transfer or PayPal. Full details for the payment of sessions will be given in your contract.

Sessions must be paid for in cleared funds at least 14 days prior to the session date to confirm your booking. Failure to pay by this date may result in a cancellation of your booking.

Delivery and Costs

Sessions will be for the session date specified in your contract with Clare Amanda Photography. Photographs from your session will be available to view and/or purchase via a secure online gallery within 14 days of the session date, unless otherwise agreed in the contract.

Contract Length and Payment Dates

The minimum length of a contract for services with Clare Amanda Photography is 28 days. Contracts must be signed and payment made at least 14 days prior to the session date to confirm the session booking. In certain pre-agreed circumstances and where certain drop-in sessions are offered a contract may be signed and payment for the session made anytime prior to the session, reducing the minimum contract length to 14 days.

Photographs will be available to view and/or purchase 14 days following the session date in the contract.

Booking Fees and Cancellations

Where Clare Amanda Photography has to cancel the pre-booked session for which a contract has been signed and fees paid, due to circumstances beyond our control, the full amount of the Session Fee and any further payments for services received will be refunded. A postponement under these circumstances will be treated as a new booking with a new contract.

Full details of postponement or cancellation of any services (sessions) by you, the client, is made clear in the terms and conditions of the contract between Clare Amanda Photography and its Client(s), however these will be subject to the following:

- Notice received 15 days or more prior to the Session date: no session fees or session extras will be payable to the Photographer.

- Notice received 14 days or less prior to the Session date: 100% of the session fee and session extras will be payable.

- Where no session details have been detailed on the original contract, the agreed balance will be accepted as being the amount stated in the terms of the specific signed contract.

- The date of cancellation will be deemed to be the date Clare Amanda Photography receives written Notice of Cancellation, as confirmed by the Clare Amanda Photography.

Right to Cancel: You have the right to cancel a signed contract within 14 days without giving any reason. The cancellation period will expire after 14 days from the date of the conclusion of the contract.

To exercise the right to cancel, you must inform the Photographer of your decision to cancel this contract by a clear statement (e.g. email). You must clearly state that you wish to cancel the contract in the communication. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired. Providing no service has been willingly received by the Client(s), the full amount paid will be refunded to the Client(s). Photographic products are not covered by the Right to Cancel as they are personalised goods.

Digital Content

Photographs will be displayed via a secure online gallery. Invitation to the gallery and access instructions will be sent to the client within 14 days of the session date.

Terms of Sale

Description of Goods and Prices

Following your photography session with Clare Amanda Photography, photographic products will be offered for sale to you via a secure online gallery, telephone, email or directly in person. Gift certificates may also be purchased via telephone, email or in person.  Current prices can be seen on this website's prices page at any time, or at checkout via the secure online gallery.

Payment Methods

Payment for products can be made by most major debit or credit cards (in person only), cheque, bank transfer or PayPal. Valid gift certificates and vouchers or offers issued by Clare Amanda Photography may also be used in full or part payment of products.

Delivery and Costs

The delivery method of products or gift certificates shall be selected and paid for upon purchasing the goods.

Gift certificates will be dispatched within 3 working days of ordering. Most photographic products will be dispatched within 10 working days of ordering.

Photo books and albums will be dispatched within 4 weeks following the customer's design and layout sign-off date.

The arrival of any goods purchased depends on the method of postage selected, for example, standard postage takes 3-5 working days, whereas express delivery takes 1-2 working days.

Contract Length and Payment Dates

All products must be paid for in full at the time of ordering, whether online or face-to-face. Products remain the property of Clare Amanda Photography until payment is received in cleared funds.

Order Cancellations

Orders for physical photographic products may be cancelled within 3 days of placing the order. Cancellations and refund requests must be made by emailing clare@clareamanda.co.uk. A reply confirmation of your email will be deemed as your confirmation of receipt.

Gift certificates may not be cancelled after they have been dispatched, until they are returned to Clare Amanda Photography.

Digital downloads may not be cancelled after they have been purchased or downloaded.

When ordering in person, as the products are personalised, refunds may only be given if a product does not meet the description of that ordered, or are defective or damaged prior to arrival. Refunds must be requested within 14 days of receipt of goods and goods must be returned within 14 days of the refund being requested.

When ordering by telephone or online, cancellation of orders may be made within 14 days of ordering, providing goods are returned within 14 days of the cancellation being requested.

For refunds that are not as a result of the products not meeting the correct description, or are defective or damaged upon arrival, the customer shall pay any costs related to the return postage.

Digital Content

Any digital photographs ordered will be delivered / downloaded in one of the following image formats: JPEG, PNG, BMP. The use of any digital photograph is governed by the respective Licence for Use which you will receive at the time of download.
